ARTICLE 1 - SCOPE OF APPLICATION
These Terms of Sale apply, without restriction or reservation, to all sales concluded by the Seller with buyers ("The Customers or the Customer"), wishing to acquire the products offered for sale ("The Products") by the Seller on the bolvivant.com website, operated by the company Épaule Carrée SAS. The Products offered for sale on the site are as follows:
- Zoetrope (with interchangeable animation strips)
- Praxinoscope (with interchangeable animation strips)
The main characteristics of the Products, and in particular the specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the bolvivant.com website, which the customer is required to read before ordering. The choice and purchase of a Product are the sole responsibility of the Customer. The Customer declares to have read these Terms of Sale and to have accepted them by validating their order. The validation of the order by the Customer constitutes acceptance without restriction or reservation of these Terms of Sale.

Hereinafter referred to as "Bol Vivant" or "the Seller".
The Products are offered for delivery in Metropolitan France, the European Union (Belgium, Germany, Italy, Spain, Portugal, Ireland, Denmark, Sweden, Finland, Poland, Netherlands, Austria), as well as the United Kingdom.
Nature and Characteristics of the Products The products offered on the bolvivant.com website are original creations designed and handcrafted by the company Épaule Carrée SAS. Due to this manual and artisanal manufacturing process:
- Uniqueness: Each piece is unique. The photographs and visuals presented on the site are as faithful as possible, but have only an illustrative value. Variations in shades, textures, or finishes may exist between the visuals and the delivered product, notably due to the rendering of colors on screen or the manual application of paints.
- Weight and Dimensions: Technical data, and in particular the weight of the objects indicated on the product sheets, are provided for information purposes only. Minor variations related to materials and artisanal manufacturing may be observed.
- Absence of barcodes: These products do not come from mass industrial production and therefore do not have barcodes (EAN or GTIN).
The Customer acknowledges and accepts these characteristics specific to artisanal work, which guarantee the authenticity of the object. The customer may not use this as a basis to demand a refund for non-conformity, as long as the essential qualities of the product remain unchanged. However, in accordance with Article 7, the Customer retains their 14-day right of withdrawal if they are not satisfied with the aesthetics of the product received.
ARTICLE 2 - PRICES AND CURRENCIES
The Products are provided at the current rates appearing on the bolvivant.com website at the time the order is registered by the Seller.
2.1 Payment currencies by geographical area
The Seller has established fixed rates per market. The payment currency is determined according to the delivery zone:
- Euro (€): Metropolitan France and European Union (Belgium, Germany, Italy, Spain, Portugal, Ireland, Denmark, Sweden, Finland, Poland, Netherlands, Austria).
- Pound Sterling (£ GBP): United Kingdom.
The price displayed in the currency corresponding to the Customer's zone is firm, final, and contractual. It is not subject to any fluctuating automatic conversion at the time of purchase.
2.2 Taxes and Customs Duties
The customer will not incur any additional charges upon receipt of their package, regardless of the delivery zone. The price displayed at the time of the order is final.

European Union (including France): Due to the free movement of goods, no customs duties apply. The price paid on the website is inclusive of all taxes (VAT included).

United Kingdom: All customs duties, import taxes (e.g., VAT), and customs clearance fees are fully covered by the Seller. The Customer will not have any fees to pay to the carrier upon delivery.
2.3 Invoicing and Payment
The payment requested from the Customer corresponds to the total amount of the purchase, including shipping costs. The final billing and collection currency is systematically specified before the validation of the order. An invoice is prepared for each order and sent to the Customer electronically after the order is received. If necessary, the Customer may also request it from contact@bolvivant.com.
Only a delivery note, including the description of the items ordered without mention of price, is attached to the package.
The payment requested from the Customer corresponds to the total amount of the purchase, including these costs. T
he rates take into account any reductions that may be granted by the Seller on the bolvivant.com site. These rates are firm and non-revisable during their period of validity, but the Seller reserves the right, outside the period of validity, to modify the prices at any time.
2.4 Shipping costs
Prices do not include processing, shipping, transport, and delivery costs. These are calculated according to the packed weight of the parcel and the destination, and are displayed before the final validation of the order.
ARTICLE 3 – ORDERS
It is the Customer's responsibility to select the Products they wish to order on the bolvivant.com website, according to the following procedures:
Product Selection (Cart)
The Customer chooses the Product(s) they wish to purchase and adds them to their cart by clicking the "Add to Cart" button.
The Customer may, at any time, view the summary of their cart, modify quantities, or delete Products before validating their order.
Identification or Account Creation
To validate their order, the Customer identifies themselves by logging into their personal space if they are already registered, or creates an account if it is their first order, or proceeds as a guest.
Delivery Choice
The Customer enters or verifies the delivery and billing information (names, full addresses, and phone numbers).
The Customer selects the desired delivery method from the options offered (if more than one option is available) and reviews the associated lead times and costs.
Summary and Acceptance of the Terms of Sale
A complete summary of the order is displayed, including the nature of the Products, the total price, the amount of VAT (for countries outside the European Union, the price is indicated excluding tax), and the shipping costs.
The Customer is required to check the accuracy of the order and has the possibility to correct any errors.
The validation of the order implies the unreserved acceptance by the Customer of these Terms of Sale, these having been acknowledged before the order was placed.
Final Validation and Payment
The final validation is done by clicking the "Order with obligation to pay" button (or any similar wording guaranteeing the Customer that placing the order implies a payment).
The Customer is then directed to the secure payment system to pay the amount of their order. The order is considered final and the contract is formed upon receipt of payment by the Seller.
Order Confirmation
The Seller acknowledges receipt of the order and payment by sending the Customer, without delay, a confirmation email containing the essential elements of the order (order number, Products, price, delivery method and lead time, Seller's contact details).
Product offers are valid as long as they are visible on the site, within the limit of available stocks. The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors.
Any order placed on the bolvivant.com website constitutes the formation of a distance contract concluded between the Customer and the Seller.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
The Customer may request the cancellation of their order at any time as long as it has not yet been handed over to the carrier for shipment.
Once the order has been shipped, cancellation is no longer technically possible. In this case, the Customer must wait for the receipt of the package to exercise their right of withdrawal and request a refund, in accordance with the procedures provided for in the "Right of Withdrawal" article of these Terms of Sale.
ARTICLE 4 - PAYMENT CONDITIONS
The price is payable in full on the day the order is placed. Payment is made via secure payment methods according to the following terms:
- Payment Cards: Visa, Mastercard, American Express, Cartes Bancaires (CB).
- Digital Wallets: Apple Pay, Shop Pay, PayPal.
Transactions are fully secured and encrypted by our authorized payment service providers. Bol Vivant does not, at any time, have access to your bank details.
Payments made by the Customer will only be considered final after the effective collection of the sums due by the Seller.
The Seller shall not be required to proceed with the delivery of the Products ordered by the Customer if the Customer does not pay the price in full under the conditions indicated above.
ARTICLE 5 - DELIVERIES
In summary: Delivery times are broken down as follows (in accordance with our Shipping Policy):
- Processing time (preparation/manufacturing): 5 business days.
- Transport time: Varies by zone (2-4 business days for France, 2-8 business days for international).
- Delay: If the Products have not been delivered 30 days after the indicative delivery date (excluding cases of force majeure), the Customer may request the cancellation of the sale in writing.
- Claims: The Customer has 3 business days after receipt to report damage related to transport to the address contact@bolvivant.com with supporting photos.
5.1 Origin of shipment
All orders placed on the Site are prepared and shipped directly from our workshop located in the Île-de-France region at 46 route d'Orsay in Marcoussis 91460 (France). This local shipment guarantees optimal traceability and compliance with the processing and routing times detailed in the following articles.
5.2 Delivery times
Deliveries, corresponding to the transport time, occur within an average indicative period of 2 to 4 business days for France and 2 to 8 business days for international destinations from the shipment of the order (and do not include the processing and manufacturing time).
The exact lead times by geographical zone (France, EU, International) are specified and available on the "Shipping Policy" page of the Site. Delivery is constituted by the transfer to the Customer of physical possession or control of the Product. Except in special cases or the unavailability of one or more Products, the Products ordered will be delivered all at once.
5.3 Delivery delay and termination
The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the timeframes specified below.
If the ordered Products have not been delivered within 30 days after the indicative delivery date, for any cause other than force majeure or the Customer's act, the sale may be terminated at the written request of the Customer under the conditions provided for in articles L 216-2, L 216-3, and L241-4 of the French Consumer Code. The sums paid by the Customer will then be returned to them no later than fourteen days following the date of termination of the contract, to the exclusion of any compensation or withholding.
5.4 Carriers and delivery methods
Deliveries are carried out by an independent carrier, to the address mentioned by the Customer during the order and to which the carrier can easily access.
Our deliveries are mainly handled by Colissimo (La Poste) or any other carrier offering an equivalent level of service with tracking. For international shipping, we use Colissimo International.
Once the package arrives in your country, it is handled by the local postal service (Royal Mail in the United Kingdom). A tracking number is provided to you upon shipment.
Delivery methods depend on the destination and the format of the Product ordered:
- Delivery in Metropolitan France: Delivery is made by default to the mailbox. However, in the event of larger dimensions not allowing insertion into the mailbox, or for certain specific Products, delivery will be made in person by the carrier.
- International delivery (EU, United Kingdom): By default, delivery is made in person (delivery against signature or according to the procedures of the local partner postal service).
5.5 Verification of products and claims
The Customer is invited to check the condition of the packaging as well as the contents of their package upon delivery.
Transport-related damage: In the event of apparent damage (open, crushed package, broken product), we strongly recommend that the Customer formulate precise reservations on the carrier's delivery note and inform Bol Vivant's Customer Service by email at contact@bolvivant.com within three (3) business days. This rapid report allows us to exercise our recourse against the carrier.
Legal Warranties: In accordance with the law, this reporting period for transport does not affect the benefit of legal warranties (legal warranty of conformity and warranty against hidden defects). If the product has a defect not related to transport, the Customer has two (2) years from delivery to act, in accordance with the provisions of Article 8 of these Terms of Sale.
5.6 Transfer of risks
The transfer of risks of loss and deterioration relating thereto will only be realized at the moment the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk, except when the Customer has chosen the carrier themselves. In this respect, the risks are transferred at the time of delivery of the goods to the carrier.
ARTICLE 6 - TRANSFER OF OWNERSHIP
The transfer of ownership of the Products from the Seller to the Customer will only be realized after full payment of the price by the latter, regardless of the delivery date of said Products.
ARTICLE 7 - RIGHT OF WITHDRAWAL AND RETURNS
In summary: In accordance with the law, the Customer has 14 days after receipt to exercise their right of withdrawal.
- Return possible within 14 days (new product, in its original packaging).
- Return shipping fees are the sole responsibility of the Customer.
- Restocking fees: No restocking fees are applied.
7.1. Period for exercising the right of withdrawal
In accordance with the legal provisions in force, the Customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to justify reasons or pay any penalty. If the period expires on a Saturday, a Sunday, or a public holiday or non-working day, it is extended until the first following business day.
7.2. Notification procedures
To exercise their right of withdrawal, the Customer must inform the Seller of their decision by an unambiguous statement (for example, by email or via our Contact form).
7.3. Return of Products
The Customer must send back the Product to the Seller without undue delay and, at the latest, within fourteen (14) days following the communication of their decision to withdraw.
Condition of the product: Products must be returned in their original condition and complete (packaging, accessories, instructions...) allowing them to be put back on the market in new condition. The Customer's liability can only be incurred with respect to the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the Product.
Return fees: In accordance with Article L221-23 of the French Consumer Code, return shipping fees are the sole responsibility of the Customer.
7.4. Refund
In the event of exercise of the right of withdrawal, the Seller shall refund the Customer for all sums paid, including delivery costs.
The refund will be made using the same means of payment as that used by the Customer for the initial transaction, unless the Customer expressly agrees to another means. The Seller may defer the refund until the Products are recovered or until the Customer has provided proof of the shipment of these Products.
7.5. Absence of restocking fees
No administrative or restocking fees will be applied by the Seller as part of a return that complies with these provisions.
ARTICLE 8 - LEGAL WARRANTIES
In summary: All our products benefit from:
- The legal warranty of conformity (2 years from delivery).
- The warranty against hidden defects (2 years from the discovery of the defect).
- Support: In the event of a proven defect, Bol Vivant will replace or refund the product. In this specific case (defect/error), Bol Vivant covers the return shipping costs by sending a prepaid label.
- Artisanal note: The handmade nature of our products implies slight variations in finish that do not constitute a lack of conformity.
The Products provided by the Seller benefit from:
- The legal warranty of conformity, for Products that are defective, spoiled, or damaged, or that do not correspond to the order.
- The legal warranty against hidden defects arising from a defect in material, design, or manufacturing affecting the delivered products and making them unfit for use.

To exercise these rights, the Client must inform the Seller, in writing (email), of the non-conformity of the Products or of the existence of hidden defects from the time of their discovery.
The Seller will refund, replace, or have repaired the Products or parts under warranty deemed non-conforming or defective.
Shipping costs will be reimbursed on the basis of the invoiced rate. Under the legal warranty of conformity, all costs for returning the product, as well as the shipping costs for any exchange product, will be fully borne by the Seller via the sending of a prepaid label.
Refunds, replacements, or repairs of Products deemed non-conforming or defective will be carried out as soon as possible and at the latest within 30 days following the Seller's finding of the lack of conformity or hidden defect. This refund may be made by bank transfer or check.
The Seller's liability shall not be incurred in the following cases:
- Non-compliance with the legislation of the country in which the products are delivered, which it is the Client's responsibility to verify.
- In case of misuse, use for professional purposes, negligence, or lack of maintenance on the part of the Client, as well as in case of normal wear and tear of the Product, accident, or force majeure.
- The photographs and graphics presented on the site are not contractual and shall not incur the Seller's liability.
The Seller's warranty is, in any event, limited to the replacement or refund of non-conforming Products or those affected by a defect.
ARTICLE 9 - PERSONAL DATA (GDPR)
In summary: The data collected (name, address, email) are necessary for order management and delivery.
- Data Controller: Bol Vivant
- Co-contractors: Carriers, Payment Providers, Shopify.
- Rights: The Customer can exercise their rights of access, rectification, or deletion by writing to contact@bolvivant.com.

The Customer is informed that the collection of their personal data is necessary for the sale of the Products by the Seller as well as for their transmission to third parties for the purpose of Product delivery. These personal data are collected solely for the execution of the sales contract.
The Customer is further informed that the collection of their personal data is also necessary for the following purposes:
Customer Relationship Management (CRM) and After-Sales Service:
- Purpose: To process requests for information, claims, returns (right of withdrawal), and the application of legal and contractual warranties.
- Justification: Necessary for the execution of the sales contract (including after-sales service) and for compliance with legal obligations (warranties).
Direct Marketing and Loyalty (Newsletter):
- Purpose: To send commercial information about Products, new products, or promotional offers, only if the Customer has consented.
- Justification: Based on the Customer's consent (checkbox during newsletter registration or ordering) or, in certain cases, on our legitimate interest (for communications on similar products already purchased, if permitted by law).
Site Improvement and Performance Analysis (Statistics):
- Purpose: To measure the audience and use of the site (page views, user journey, etc.) to improve the customer experience, site performance, and product offering.
- Justification: Based on our legitimate interest (ensuring the technical functioning of the site and continuous service improvement) or, if the tool uses non-essential cookies, on the user's consent.
9.1 Collection of personal data
The personal data collected on the bolvivant.com website are as follows:
- Order of Products: When the Customer orders Products: first names, last names, postal address, and email address (in addition to bank payment data), and phone number for deliveries.
- Payment: As part of the payment for Products offered on the bolvivant.com site, the latter records financial data relating to the Customer / user's bank account or credit card.
9.2 Recipients of personal data
Personal data are used by the Seller and its co-contractors for the execution of the contract and to ensure the efficiency of the sale and delivery of Products. The category(ies) of co-contractor(s) is (are):
- Transport providers,
- Payment providers (banks, Apple Pay, Shop Pay, PayPal, etc.),
- Shopify.
9.3 Data Controller
The data controller is the Seller, within the meaning of the French Data Protection Act (Loi Informatique et libertés) and, as of May 25, 2018, Regulation 2016/679 on the protection of personal data (GDPR).
9.4 Limitation of processing
Unless the Customer expresses their explicit agreement, their personal data are not used for advertising or marketing purposes.
9.5 Data retention period
The Seller will keep the data collected for a period of 5 years, covering the duration of the applicable statute of limitations for contractual civil liability.
9.6 Security and confidentiality
The Seller implements organizational, technical, software, and physical digital security measures to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the internet is not a completely secure environment and the Seller cannot guarantee the security of the transmission or storage of information on the Internet.
9.7 Implementation of Customer and user rights
In accordance with the regulations applicable to personal data, Customers and users of the bolvivant.com site have the following rights:
- They can update or delete the data concerning them in the following way:
- By contacting us by email: contact@bolvivant.com
- They can exercise their right of access to know the personal data concerning them by writing to the address indicated above.
- If the personal data held by the Seller are inaccurate, they can request the update of the information by writing to the address indicated above;
- They can request the deletion of their personal data, in accordance with applicable data protection laws, by writing to the address indicated above;
- They can also request the portability of the data held by the Seller to another provider;
- Finally, they can object to the processing of their data by the Seller.
These rights, provided they do not conflict with the purpose of the processing, may be exercised by sending a request by mail or email to the Data Controller whose contact details are indicated above.
The data controller must provide a response within a maximum period of one month.
In the event of a refusal to grant the Customer's request, the refusal must be justified.
The Customer is informed that in case of refusal, they may lodge a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS) or refer the matter to a judicial authority.
The Customer may be invited to check a box by which they agree to receive informative and promotional emails from the Seller. They will always have the possibility to withdraw their consent at any time by contacting the Seller (contact details above) or by following the unsubscribe link.
ARTICLE 10 - INTELLECTUAL PROPERTY
The content of the bolvivant.com site is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an infringement offense.
ARTICLE 11 - APPLICABLE LAW
These Terms of Sale and the operations resulting from them are governed by and subject to French law.
These Terms of Sale are drafted in the French language. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
